Terms of Use

These Terms of Use apply solely to Timber™ and do not govern the use of any other SavvyPhone, LLC products or services, including SavvyCard®, RE-Target®, or any other SavvyPhone product. Use of those products is governed by their respective terms of use, available at www.savvycard.com/terms.
1. Consent
PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING TIMBER™ (THE “SYSTEM”). BY CREATING AN ACCOUNT, ACCESSING, OR USING THIS SYSTEM, YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT ACCEPT THESE TERMS OF USE, DO NOT USE THIS SYSTEM.
This System is owned and operated by SavvyPhone, LLC (“SavvyPhone,” “we,” “us,” or “our”). Timber™ is a home management platform that enables homeowners to store home-related documents, photos, records, and other information; interact with an AI assistant about their home; track home improvements and maintenance; and access home services and related commerce. You acknowledge that these Terms of Use are supported by reasonable and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, including your use of the System and receipt of data, materials, and information available at or through the System.
2. Important Notice Regarding Sensitive Personal Information
Timber™ is designed to serve as a secure digital repository for home-related documents and records. You understand and acknowledge that documents you upload or store in Timber™ may contain sensitive personal information, including but not limited to: Social Security Numbers (SSN), dates of birth, financial account numbers, bank statements, tax records, insurance policies and claims, mortgage documents, contractor agreements, and other personally identifiable information. BY USING TIMBER™’S DOCUMENT STORAGE AND RELATED FEATURES, YOU EXPRESSLY CONSENT TO SAVVYPHONE STORING SUCH SENSITIVE PERSONAL INFORMATION ON YOUR BEHALF, IN ACCORDANCE WITH THESE TERMS OF USE AND TIMBER™’S PRIVACY POLICY.
SavvyPhone implements industry-standard security measures to protect your data; however, the security of your account and the information stored within it also depends significantly on you. You bear shared responsibility for the security of information you store in Timber™, as described in Section 6 below.
3. Timber™ Service Description
Timber™ provides homeowners with a personalized, AI-powered home management application that may include the following features and capabilities:
- AI-powered chat and home data assistant
- Document storage for home-related records (purchase documents, warranties, permits, insurance policies, improvement receipts, and other home-related files)
- Photo and media storage for home documentation
- Home improvement and maintenance tracking
- Public record data integration (property history, square footage, construction details)
- MLS data integration (listing history, neighborhood comparables, valuation tools), where available through an MLS partner
- Home services directory and contractor referrals
- Commerce features including insurance shopping, home service referrals, and affiliate offers
- Push notifications and alerts related to your home
- Agent and brokerage connection (where applicable)
Some features may require a paid subscription. Free trial periods and subscription terms are disclosed at the time of registration. SavvyPhone reserves the right to add, modify, or discontinue features at any time.
4. Modification; Discontinuance
We reserve the right to modify or otherwise update these Terms of Use at any time, and you agree to be bound by such modifications, updates, and revisions. Any changes will be effective immediately upon posting the revised version of these Terms of Use to the System. Your continued use of the System after the effectiveness of such changes will constitute acceptance of and agreement to any such changes. During initial registration, and periodically thereafter, you may be required to click “Accept” for the Terms of Use, acknowledging and consenting to its contents. Any material revisions may require an additional “Accept” prior to re-entry into the System.
We may change the System or delete content or features of this System at any time, in any way, for any or no reason, at our sole discretion. We may alter, suspend, or discontinue the System at any time, without notice.
5. User Accounts
To use Timber™, you must create an account by providing accurate, complete, and current registration information. You represent and warrant that all information you provide is true and accurate, and you agree to keep such information current.
You must be at least 18 years of age to create an account and use Timber™. By creating an account, you represent that you are at least 18 years of age.
Each account is for a single user and may not be shared or transferred to another person without our prior written consent. You are responsible for all activity that occurs under your account.
6. Account Security and Your Responsibilities
The security of your Timber™ account — and the sensitive information stored within it — depends in large part on you. You are responsible for:
- Keeping your password and login credentials strictly confidential. Do not share your username, password, or any other account credentials with any other person.
- Using a strong, unique password for your Timber™ account and updating it periodically.
- Enabling multi-factor authentication if and when offered by Timber™.
- Immediately notifying SavvyPhone of any unauthorized access to or use of your account, or any other breach of security, by contacting us at privacy@timber.homes or the contact information in Section 20 below.
- Logging out of your account at the end of each session, especially when accessing Timber™ from a shared or public device.
- Exercising caution when accessing Timber™ from public Wi-Fi networks or shared computers.
- Ensuring that any device you use to access Timber™ is adequately protected with appropriate security software and access controls.
- Being mindful of the sensitivity of the documents and information you choose to upload to Timber™.
SavvyPhone will not be liable for any loss or damage arising from your failure to comply with these security responsibilities. If you permit others to access your account or share your credentials, you assume full responsibility for any resulting activity, disclosure of sensitive information, or breach of these Terms of Use.
7. Copyright
All information, materials, functions, and other content provided on this System (collectively “Content”), such as text, graphics, logos, images, audio recordings, video recordings, data compilations, and software, is our property or the property of our licensors, and is protected by United States and international copyright laws and other intellectual property laws and protections as applicable. ©2026 SavvyPhone, LLC. We grant you a limited, revocable, non-exclusive license to access and make personal use of the System and the Content, subject to these Terms of Use. This license does not include any resale or commercial use of the System or its contents; any derivative use of the System or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.
8. Intellectual Property
SavvyPhone, SavvyCard, RE-Target, and Timber™ are registered trademarks and/or trademarks of SavvyPhone in the United States and/or other countries. Nothing on this System should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on the System without our express written permission. All other trademarks not owned by SavvyPhone that appear on this System are the property of their respective owners.
One or more patents may apply to this System and to the features and services accessible via the System, including without limitation U.S. Patent No. 9,625,344 and all corresponding foreign counterparts.
9. Use of System and Content
You are granted a limited, revocable, nonexclusive right to use the System for your personal, non-commercial home management purposes, subject to these Terms of Use. You agree not to:
- Use the System for any unlawful purpose or in violation of any applicable law or regulation
- Upload, store, or transmit any content that infringes any third party’s intellectual property rights
- Upload content containing malware, viruses, or any other malicious code
- Attempt to gain unauthorized access to any portion or feature of the System, or to any other systems or networks connected to the System
- Resell, sublicense, or otherwise commercially exploit the System or any Content
- Use data mining, robots, scrapers, or other automated data collection tools on the System
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the System or the data contained therein
10. User Content and Document Storage
Timber™ allows you to upload, store, and manage a variety of content including documents, photographs, receipts, records, and other files related to your home (“User Content”). You retain ownership of all User Content you upload to Timber™. By uploading User Content, you grant SavvyPhone a limited, non-exclusive, worldwide license to store, process, and display your User Content solely to the extent necessary to provide the Timber™ service to you.
You are solely responsible for the User Content you upload to Timber™, including ensuring that you have the right to upload and store such content and that the content does not violate the rights of any third party or any applicable law. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to upload your User Content.
You acknowledge and agree that Timber™’s document storage features are intended for your personal home management use. You are solely responsible for determining whether any particular document or category of information is appropriate to store in Timber™ and for understanding the sensitivity of information contained in documents you choose to upload. SavvyPhone will not be liable for any harm arising from your decision to upload, store, or provide access to any particular document or information.
11. AI Features
Timber™ includes artificial intelligence features that allow you to interact with your home data through a conversational interface. These AI features are provided to assist you in managing your home and should not be relied upon as professional advice, including without limitation legal, financial, tax, insurance, engineering, or contracting advice. Always consult a qualified professional before making significant decisions about your home.
AI-generated responses are based on the information available in your Timber™ account and other data sources, and may not always be accurate or complete. SavvyPhone makes no warranty regarding the accuracy, completeness, or fitness for a particular purpose of any AI-generated content.
12. Home Services
Timber™ may provide access to a directory of home service providers, contractor referrals, insurance shopping tools, and other home-related commerce features. SavvyPhone is not a licensed contractor, insurance agent, or financial advisor, and does not provide professional advice in any of these areas.
Service providers listed in or referred through Timber™ are independent businesses. We do not guarantee the quality, accuracy, or fitness of services provided by any third-party service provider. Any transactions between you and a service provider are solely between you and that service provider, and SavvyPhone is not a party to such transactions.
Insurance shopping features are provided for informational purposes only. Any insurance purchasing decisions are made by you and any resulting insurance contracts are between you and the applicable insurance carrier. SavvyPhone receives referral compensation in connection with some commerce features, as disclosed in our Privacy Policy.
13. Privacy Policy
Your use of Timber™ is also governed by Timber™’s Privacy Policy, which is incorporated into these Terms of Use by reference. Please review Timber™’s Privacy Policy carefully at www.timber.homes/privacy. It describes how we collect, use, and disclose information about you, including sensitive personal information you store in Timber™. The Timber™ Privacy Policy is separate from and does not modify the SavvyCard® Privacy Policy available at www.savvycard.com/privacy.
14. Third-Party Services and Links
The System may contain links to third-party websites, applications, and services that are not owned or controlled by SavvyPhone. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We encourage you to review the terms of use and privacy policies of any third-party websites or services you access through Timber™.
Some features of Timber™ may be powered by third-party services, including mapping, analytics, AI, and payment processing. Your use of such features may be subject to the terms and privacy policies of those third-party providers.
15. Disclaimer of Warranties
THE SYSTEM AND ALL CONTENT AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SAVVYPHONE DOES NOT WARRANT THAT THE SYSTEM WILL BE UNINTERRUPTED, SECURE, OR FREE FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.
WITHOUT LIMITING THE FOREGOING, SAVVYPHONE MAKES NO WARRANTY THAT: (A) THE SYSTEM WILL MEET YOUR REQUIREMENTS; (B) RESULTS OBTAINED FROM USE OF THE SYSTEM WILL BE ACCURATE OR RELIABLE; (C) ANY ERRORS IN THE SYSTEM WILL BE CORRECTED; OR (D) THE SYSTEM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SAVVYPHONE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SYSTEM, EVEN IF SAVVYPHONE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL SAVVYPHONE’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SYSTEM EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO SAVVYPHONE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.
17. Indemnification
You agree to defend, indemnify, and hold harmless SavvyPhone, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms of Use; (b) your User Content; (c) your use of the System; (d) your breach of any representations or warranties made herein; or (e) your violation of any applicable law or the rights of any third party.
18. Termination
We may terminate or suspend your account and access to the System at any time, with or without cause or notice, including if we believe you have violated these Terms of Use. You may terminate your account at any time by contacting us at the contact information provided in Section 20.
Upon termination, your right to use the System will immediately cease. Provisions of these Terms of Use that by their nature should survive termination shall survive, including, without limitation, intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.
Upon account termination or your request for data deletion, SavvyPhone will delete or render inaccessible your User Content in accordance with our Privacy Policy, subject to any legal retention obligations.
19. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Agreement to Arbitrate. You and SavvyPhone agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use, your use of Timber™, or the breach, termination, enforcement, interpretation, or validity thereof (collectively, “Disputes”) will be resolved solely by binding, individual arbitration and not in a class, representative, or consolidated action or proceeding. You and SavvyPhone agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement, and that you and SavvyPhone are each waiving the right to a trial by jury or to participate in a class action.
Exceptions. Notwithstanding the above, either party may bring an individual action in small claims court. Either party may also seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s intellectual property rights or confidential information, pending resolution of the dispute through arbitration.
Arbitration Rules and Process. Any arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, as amended by these Terms. The AAA’s rules are available at www.adr.org. The arbitration will be conducted in Pinellas County, Florida, unless you and SavvyPhone agree otherwise. Each party is responsible for paying its own arbitration fees in accordance with AAA rules; however, if you prevail in arbitration, SavvyPhone will reimburse your arbitration filing fee.
Waiver of Class and Representative Actions. YOU AND SAVVYPHONE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and SavvyPhone agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
Severability. If any part of this arbitration provision is found unenforceable, that part shall be severed and the remainder of this Section shall continue in full force and effect. If the class action waiver is found unenforceable, the entire arbitration provision shall be null and void and any Dispute shall be resolved in court pursuant to Section 19.
Opt-Out Right. You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to termsofuse@timber.homes within 30 days of first accepting these Terms of Use. Your notice must include your name, your Timber™ account email address, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration does not affect any other provisions of these Terms of Use.
